Open for Comment: Proposed Affordable Care Act Rule Changes

On December 28, HHS announced a set of proposed Affordable Care Act rule changes for health insurance plans that are described as measures to expand access to health insurance coverage options.

The proposed changes, which are open for public comments for 30 days, are summarized in HHS Notice of Benefit and Payment Parameters for 2023 Proposed Rule Fact Sheet. Many proposed changes deal with the complexities of how health insurance plans operate in terms of, for example, how many Essential Community Providers (agencies serving vulnerable populations) must be included in a plan's service area. 

Another proposed change will restore the rule on non-discrimination based on gender identity and sexual orientation, which was removed in 2020.
