The Coronavirus Disease 2019 (COVID-19) public health emergency continues to pose significant challenges for Ryan White HIV/AIDS Program (RWHAP) recipients, providers, and clients to provide and access care. Last year, we released a program letter outlining six RWHAP statutory penalties and administrative requirements that would be waived for fiscal years 2020 and 2021 in order to provide greater flexibility and administrative relief from penalties that would be otherwise applicable. After a review of the utilization of the prior waivers and the continued impact of COVID-19 on RWHAP recipients, three of the six waivers will be extended into FY 2022 as outlined in the new program letter released on April 26, 2022.
As a reminder, there are two “buckets” of waivers: automatic and non-automatic. Automatic waivers apply to penalties that will be waived for all applicable recipients for RWHAP funding as they pertain to RWHAP provisions and funding limitations. Non-automatic waivers apply to penalties that may be waived if requested. Note: the unobligated balances (UOB) waiver will no longer be an automatic waiver and will only be available for FY 2022 funding by request.
Upon approval, HRSA will issue a revised Notice of Award to the recipient.
